TERMS AND CONDITIONS OF THE "HERNING FAIR" COMPETITION

1- ORGANISING COMPANY, OBJECT AND TERRITORIAL SCOPE

The commercial entity Deltamar World, S.L. (hereinafter, AR Hotels), with C.I.F. (Fiscal Identification Code)B 03528874, domiciled in Calpe (Alicante), calle Ponent, nº 1, cp 03710, and registered in the Mercantile Register, Book 0, volume 2608, Folio 124, Page A74192, Entry 1, in compliance with its corporate purpose, organises and is responsible for the development of a promotion, called "Herning fair draw" which consists of a competition for one (1) complete 7-day (6 nights) getaway in Calpe for 2 people, consisting of: (1) room for a maximum of 2 people, for six (6) nights at the AR Diamante Beach Hotel on half board basis valued at 826€ (826 euros).

Participation in the following promotion implies the acceptance, without exception, by the participants of these terms and conditions, as well as the criteria applicable by AR Hotels in the development of this competition. Furthermore, by participating in the promotion, the user agrees to receive promotional information from the companies of the AR Hotels Group, of which Deltamar World, S.L. is a member. You can obtain a complete list of all the companies in the Group through this link: https://www.ar-hotels.com/ .

At any time, and always free of charge, you may exercise any of the data protection rights provided for, as well as directly contact our Data Protection Officer ([email protected]), from whom you may request any information about our Privacy Policy.

Legal basis: consent to participate in the prize draw; legitimate interest, to receive commercial information from AR Hotels Group. In determining the legitimate interest of the company, the following have been taken into account:

The expectation of privacy of contest participants;
The defence of the fundamental rights and freedoms of the persons concerned;
AR Hotels' interest in maintaining commercial contact with users who have wished to participate in our competition and who have entrusted us with their personal contact details.

Retention period: maximum 10 years from the last interaction with the user.

Data protection rights: all those provided for in the applicable legislation at all times, by sending a simple email to: [email protected].

The Promotion is governed by the rules set out below.

2- DEADLINE TO PARTICIPATE IN THE AWARDING OF THE PRIZES

On 26 February 2022, the Landing Page (https://giveaway.ar-hotels.com/) for participation in the promotion will be activated. The duration and deadline for participating in the competition starts on 26/02/2022 at 08:00h (CEST) and ends on 27/02/2022 at 00:00h (CEST). The winner will be informed by a publication on AR Hotels' Facebook and Instagram profiles on 15 March 2022. And, once the winner accepts the prize, we will communicate via email.

3- REQUIREMENTS FOR PARTICIPATION

Any natural person over 18 years of age who has filled in the details on the form, as described in clause FOUR of the rules, may participate in this promotion and win the prizes.

The right to participate in the competition is free of charge.

4- MECHANICS OF THE DRAW

During the "Promotional Period", the competition will be activated on the landing page: https://giveaway.ar-hotels.com/ including the link to these terms and conditions in the landing page form.

Then, in order to participate in the competition, the participant must fill in the complete form and leave their contact email address. The competition will be held among users who have fulfilled all the requirements.

Among all the participants who have fulfilled the requirements, the winner will be chosen and will be awarded with a (1) complete 7-day (6-night) getaway in Calpe for 2 people, consisting of: (1) room for a maximum of 2 people, for six (6) nights at the AR Diamante Beach Hotel on half board basis valued at 826€ (826 euros).

AR HOTELS shall not be held responsible for any incident that may interrupt the service preventing participation in the Promotion. Likewise, AR HOTELS will not provide data service connectivity nor will it be responsible for any incident of the operators that may prevent participation in the same.

Personalisations allusive and/or with sexual, violent, denigrating, racist, discriminatory, defamatory content, as well as threats or insults that may offend a person's sensibilities will not be accepted. In any case, AR HOTELS reserves the right to delete comments in the publication and prevent the participation of those users whose comments show inappropriate content and inform Facebook or Instagram.

The reproduction and representation of all or part of the elements that make up the competition are expressly prohibited. The images or messages sent by participants within the framework of the Promotion may not be used as a support for the dissemination of contents that contravene good customs, public order, the rights of third parties or the applicable laws and regulations. By way of example and without limitation, they may not be used to participate in the Promotion:

Images, statements or messages of a defamatory, libellous, obscene, obscene, racist and offensive nature or which make mention of illegal activities in any form;
Content of a violent or pornographic nature, or which is likely to offend against respect for the human person or human dignity, against equality between women and men, or against the protection of children and adolescents;
The usurpation of a name, e-mail address, company name or trademark.
The publication, in whole or in part, of content protected by an intellectual property right and for which users do not have rights, as well as messages constituting counterfeiting of a registered trademark.

Participants are expressly prohibited from advertising, canvassing, canvassing or proselytising for professional, commercial or political purposes, such as advertising, "spam" content or references to other products, commercial offers or websites.

AR HOTELS reserves the right to remove from participation in the Promotion and from its profiles on the different social networks where the Promotion is advertised any response contrary to the provisions set out in these terms and conditions.

5- DATE OF ANNOUNCEMENT OF THE WINNER

The competition where the winner will be chosen, among those who have participated, will be held and communicated via social networks, Facebook and Instagram, on 15 March 2022, once the prize has been accepted by the winner, the communication will continue via email. The AR HOTELS group reserves the right to modify this date at its convenience, provided that there is a justified cause.

Any change in the publication date will be announced as soon as possible, together with the corresponding justification.

6- CHARACTERISTICS OF THE COMPETITION AND DESIGNATION OF WINNERS
The gift of one (1) complete 7-day (6-night) getaway in Calpe for 2 people, consisting of: (1) room for a maximum of 2 people, for six (6) nights at the AR Diamante Beach Hotel on half board basis valued at €826 (826 euros). will be randomly selected among all participants who meet the conditions specified in these rules using the application's own random system.

This system will be used to randomly select the winner and an alternate, who will replace the winner in the event of incomplete or incorrect identification or noncompliance with the requirements set out in these rules.

7- AWARDS

The prize of this Promotion will consist of one (1) complete 7-day (6-night) getaway in Calpe for 2 people, consisting of: (1) room for a maximum of 2 people, for six (6) nights at the AR Diamante Beach Hotel on half board basis valued at 826€ (826 euros).

The prize may be replaced by another of similar value and similar characteristics in the event of force majeure. The prize must be booked in advance by contacting the AR Hotels reservation centre and cannot be used between 15/06/2022 and 15/09/2022.

8- COMMUNICATION OF THE WINNER

The AR HOTELS group will contact the winner of the prize draw by email. The winner will have seven (7) days to contact the AR Hotels group via email in order to communicate acceptance of the prize and provide their personal contact details. If after this period the winner has not accepted the prize via the procedure indicated above, the prize will be passed on to the substitute, proceeding in the same manner as indicated above.
In the event that AR HOTELS is unable to locate the winners or, where applicable, the substitutes, AR HOTELS reserves the right to declare the prize void.

Each winner is responsible for providing true, complete and accurate information. The provision of inaccurate data or the refusal to provide the requested data will imply the loss of the right to the prize by the winner.

The winner will be given a voucher for a complete getaway in Calpe for a maximum of four (2) people by e-mail after the prize acceptance communication. The prize will be sent within a maximum period of seven (7) working days after the winner accepts the prize, having seven (7) days to do so. If the winner does not accept the prize, AR HOTELS will communicate with the substitute.

9- PUBLICATION OF THE NAME OF THE WINNER OF THE COMPETITION AND USE OF THE PHOTOGRAPHS

Participation in the competition implies express authorisation by the winner to the AR HOTELS group to use his/her name and surname for advertising purposes. The aforementioned data will become part of the group's databases and will be included in the lists of the Marketing Cloud tool for subsequent use in the brand's commercial mailings. Likewise, the AR Hotels group undertakes not to share this data with third parties.

10- ACCEPTANCE OF THE TERMS AND CONDITIONS OF THE DRAW

Participation in this Promotion implies full acceptance of these terms and conditions by the participants. AR Hotels reserves the right to modify or cancel the conditions of the Promotion at any time due to circumstances beyond its control or which make it advisable, and must publish said change on the website and in the same media as the initial rules, and the change will come into effect from the day following its publication.

11- EXCHANGE AND ENJOYMENT OF THE PRIZE

The prizes contained in this Promotion may under no circumstances be subject to change, alteration, cash compensation or assignment at the winner's request.

12- LIMITATION OF PARTICIPATION
Legal entities and persons under 18 years of age are not eligible to participate in this Promotion. Likewise, the participation of employees of the AR Hotels group, as well as collaborating companies, will be excluded from the competition.

13- RESERVATIONS AND LIMITATIONS

AR Hotels is exempt from any responsibility in the event of any error in the data provided by the winners themselves that would prevent them from being identified.

AR Hotels accepts no responsibility for damages of any kind that may occur during the transfer or the experience; likewise, the transfer to the restaurant will not be the responsibility of AR Hotels. Nor any extra service that is enjoyed and that is not specified in the promotion.

AR Hotels accepts no responsibility for problems of temporary lack of availability or continuity of the functioning of the services through which the participants take part in the Promotion, and in particular, although not exclusively, for failures in accessing the different pages and sending participation responses via the Internet.

AR Hotels reserves the right to make changes to ensure the success of the Promotion in the event of just cause or reasons of force majeure preventing it from being carried out in the manner set out in these terms and conditions. Likewise, it reserves the right to shorten, extend, modify or cancel this Promotion, should exceptional circumstances arise that prevent it from being carried out, communicating said circumstances in such a way as to avoid any harm to the participants in the Promotion. AR Hotels shall also not be liable for cases of force majeure that may prevent the winner from enjoying all or part of their prize.

Likewise, AR Hotels shall be exempt from all liability in the event of any of the aforementioned cases.

14- FRAUD

AR Hotels or any entity that is professionally linked to this Promotion may, without any prior notification and unilaterally, remove the registration of any participant whose anomaly is detected and/or who is suspected of preventing the normal development of his/her participation in this Promotion, illegally altering his/her registration or participation by means of any technical or computerised procedure in order to falsify his/her participation. In this regard, it is important to add that AR Hotels has provided the necessary technological support to detect any possible fraudulent, anomalous or fraudulent action that seeks to alter participation in this Promotion with the aim of obtaining a prize in an unlawful manner.

15- PERSONAL DATA

The personal data that you provide in order to participate in this promotion will be processed by the commercial entity Deltamar World, S.L. (hereinafter, AR Hotels), with C.I.F. B 03528874, domiciled in Calpe (Alicante), calle Ponent, nº 1, cp 03710, and registered in the Mercantile Register, Book 0, volume 2608, Folio 124, Page A74192, Entry 1, which will process said data in its capacity as Data Controller for the purpose of managing your participation in the promotion.

The legal basis that justifies the processing of your data is the consent that you provide us with as the owner of the data. In the case of receiving information from other companies in the AR Hotels Group, the legal basis is the legitimate interest of the company. The information you provide must be truthful and authentic. Otherwise, you will be liable for any damage you may cause to the company or to third parties by not providing authentic data.

16- CUSTOMER SERVICE

The customer-contestant attention system is established as the possibility of calling 965 832 618 from Monday to Friday from 9.30 am to 6.30 pm, belonging to AR HOTELS, which will provide information on all aspects related to the Promotion.

17- CONSULTATION OF BASES
The Bases of the present Promotion will be available to any person who wishes to consult them linked to the landing page of the promotion.

18- APPLICABLE LAW AND JURISDICTION

The terms and conditions of the competition are governed by Spanish law. AR Hotels and the participants, expressly waiving any other jurisdiction, submit to the competent Courts and Tribunals for any dispute that may arise from this Promotion.
